Well when people that make a living off taking photos and actually make a hard effort to get the get go to take photos at the pipe for magazines, when someone just posts photos of it for free on Facebook it will make the magazine look less interesting and will prob stop people form buying it. Im not too fussed but thats why i didnt post any pictures because i actually want to work for so called magazines
I get that. I’m talking about recreational photos which I would take, or that which Azz posted. These are amateur photos taken for fun / social media. You can’t compare a photo of a melting pipe with a closed sign in front of it, to a professional action photo taken of Shaun White boosting double corks out of the pipe. They are very different images for very different purposes. Not to mention the countless photos of the pipe already circulating on basically every major snowboarding website in the world. Still, if someone posted a professional photo of Shaun actually shredding the pipe, that’s a different ball game and one that’s worth money.
The accepted ethical approach is to give credit to the photographer when reporting.

I have 3 images that I took yesterday of Shaun White busting out of the pipe. They look far from amateurish ! I have not published these anywhere….yet. I’m just working out what to do with them to be honest.

and in Miss-Snowitall news, Perisher have confirmed that they have lodged application for construction a Superpipe and have taken delivery of pipecutter for same.

Anything on the internet IS FAIR GAME (especially with photos) - had this explained to me by law firms while approaching a federal court case. At the end of the day it comes down to a Judge to apply his personal opinion.
As a professional photographer it’s my business to know the law, it’s criminal business practice not too.
I keep thinking of the practice of taking photos;
You can legally take a photo of any person while standing on public land (like of people inside their house, through a window, from the roadside), but you must not take a photo of a child in any situation/place. To the extent of it being a criminal practice and in breach of the child protection act. Ethically it’s wrong. So is it Ethically wrong to take a photo through a window. I’ll add to that; it’s ethically wrong to take anyones photo without first asking. The police will take action on ethically wrong photo taking depending on extent. eg; taking photos of people on the beach in bathers without consent.
Pro athletes, like performers rely on their personal image to make money. This is kind of borderline; those public figures own their image and any money made from their image. But photographers can take (and use their image for profit) if taken from public spaces.
You cannot take photos from private land - Perisher is not on Public Land and they have a lease for that land - IT’S PRIVATE (as are all Nat.Parks).
There are readily available forms to apply to take photo’s/video in the Kosci.NP on the Perisher website.
If a photographer hasn’t done the paperwork and paid the fees then they are not professional. They are breaking the law if they are claiming their photo’s are professional.
As an amature photog if your images are online anyone can use them - it then comes to ethics whether people give credit to the people taking them.
It’s up to the amature to be ethically responsible for image content.
Basically: fb/ig don’t own the images taken by amateurs in Perisher and the photographer doesn’t own them. It’s my closest understanding, that in the eye’s of the law, the one closest to owning those images are Perisher. Unless the correct red tape had been lodged. An dif you paid those fees you wouldn’t post them online without getting some cash in your pocket first.
Internet = sharing of information. It’s a great way of studying humanity and it’s ethics.
